Tise Points Terms and Conditions (Australia)

By creating a Tise account you automatically agree to the following Tise points Terms and Conditions ("Terms"). These terms are between you and eBay Marketplaces GmbH ("Tise", "we", "us" or "our") and govern our respective rights and obligations in respect of the Tise points. Please note that your use of our applications, websites, features, services, products and tools (the "Services") and your Tise points are also governed by Tise's User Terms of Service ("User Terms") and all other applicable policies in the region in which you originally created your account.

1. Collecting Tise points

  1. You automatically collect Tise points when you create a Tise account in Australia. Your Tise points are linked to your Tise account and will continue to accrue automatically.
  2. When you collect Tise points you enter into a binding agreement between you and Tise, based on these Terms.
  3. You are under no obligation to use your Tise points and may discontinue using them at any time.

2. Benefits of Tise points: Collecting Tise points

  1. Tise points are points that Tisers can collect, free of charge, in the Tise app and/or website by completing specific activities defined as "Qualifying Action(s)" on the Tise points Help Page.
  2. The number of Tise points collected for each Qualifying Action is specified on the Tise points Help Page. For promotions that allow the collection of multiple points, the maximum number of Tise points available will be explicitly communicated as part of that promotion.
  3. Tise reserves the right, at any time and in its discretion, to exclude individual categories or listings from Qualifying Actions. Any such categories or listings will be clearly disclosed to you.
  4. For Qualifying Actions involving purchases, Tise points can only be collected for completed purchases, meaning that in cases of lost packages, cancelled purchases, or other uncompleted transactions, no points will be earned. Tise points are only granted once the package has been successfully delivered and confirmed by both parties.
  5. In the case of Qualifying Actions where Tise points have been used as part of the transaction, and a full or partial refund is made to you as a buyer, the Tise points will be returned to your points balance. If the refund only covers part of the transaction value (calculated as a percentage), Tise points will be returned to your points balance in the same percentage.
  6. If you collect Tise points for creating a listing and subsequently delete that listing those Tise points will be deducted from your Tise points balance.
  7. There is no limit on the number of Tise points which you can accrue but a maximum of 50,000 Tise points can be collected in each 24 hour period.
  8. Tise points will expire six (6) months after the date each point is collected.

3. Benefits of Tise points: Redeeming Tise points

  1. When Tisers purchase and pay for an item in the Tise app and/or website they can redeem points to be used:
    1. as a discount on applicable delivery/ shipping costs;
    2. as a discount on any service fees imposed by Tise;
    3. in any other way specified pursuant to a special promotion that Tise may offer from time to time. Tise makes no representations or guarantees as to the availability, frequency, quantity or content of any such special promotions.
  2. Tise reserves the right at any time, in its discretion, to vary the categories or listings for which Tise points may be redeemed. Where such variation involves a reduction in the categories or listings for which redemption is available, Tise will provide you with 30 days' notice of such variation.
  3. Tise points have no cash value and cannot be redeemed for cash at any time.
  4. You cannot begin to redeem Tise points until you accrue 1,000 Tise points. Tise points can only be redeemed in multiples of 1,000 points.
  5. You may not transfer or assign your Tise points nor any benefits obtained from the same, including Tise points, to any other person including another Tise user.
  6. Tise reserves the right at any time to vary the rate at which Tise points can be collected or redeemed. Where Tise varies the rate which results in a reduction to the Tise points benefits, it will provide you with 30 days notice before the varied rate becomes effective.

4. Actions on your Tise account

  1. Your ability to collect and redeem Tise points ends upon the termination, cancellation or deletion of your Tise account. Further, your ability to collect and redeem Tise points will cease for the duration of any period that your account is suspended.
  2. Any Tise points that you have accrued will be deleted upon termination, cancellation or deletion of your Tise account.
  3. Tise reserves the right to reduce your Tise points balance to zero and/or take action on your account in accordance with clause 19 of the User Terms where:
    1. you fraudulently use Tise points;
    2. your use of Tise points breaches these Terms, the User Terms, or any applicable law; or
    3. we consider that your use of Tise points is detrimental to other members' use of Tise points and/or Tise's legitimate business interests.
  4. If you believe that your Tise account and/or Tise points have been incorrectly handled, you should contact customer service providing your reasons. Tise will consider such requests in good faith.

5. Limitation of Liability

  1. To the extent permitted by the law, Tise will not be liable for any loss incurred by you, or for any costs, damages, accident, delay, technical malfunction, injury, expense or inconvenience that arise as a result of or in connection with your Tise points. Nothing in this clause limits or restricts any rights you may have under the Australian Consumer Law.

6. Additional Terms

  1. We may, in our sole discretion, assign our rights and obligations under this agreement, either wholly or in part, to our affiliates.
  2. We may amend these Terms at any time by posting the amended terms on our app and/or website. We will notify you of any material amendments directly to the email address linked to your account, and/ or via in-app or website notifications. Except as stated elsewhere, all amendments will automatically be effective after they are posted.
  3. The provisions of the Tise Privacy Notice apply to your use of the Tise points. You should refer to this policy for details of how we collect and use your data and your rights in respect of the same.
  4. If any provision of these terms is held to be invalid or unenforceable, such provision will be severed and the remaining provisions will remain in effect.
