These Terms of Service (“Terms”) are a contract between you and eBay Marketplaces GmbH (“Tise”, “we”, “us” or “our”). Please read them carefully.

1. Who we are and how these Terms work
Tise is provided to you by eBay Marketplaces GmbH, Helvetiastrasse 15/17, 3005 Bern, Switzerland. Company details and contact points are listed at the end of these Terms.
These Terms together govern your access to and use of our websites, applications, features, services, products and tools in the region in which you originally created your account (the “Services”). If you use Tise in a different region to the one you signed up in, you acknowledge and agree that you will need to accept and be bound by the Tise terms of that region.
By creating an account, accessing or using the Services, you agree to these Terms. If you don’t agree, please don’t use the Services.
2. Scope
All of our Policies (as defined below) and additional terms posted on our websites or applications (as updated from time to time) form part of these Terms and are incorporated by reference.
It is important to ensure you read and understand our Policies, as well as any applicable terms for particular Tise services that you choose to use. There may be specific rules or Policies that apply to your Tise activity, and it is your responsibility to check our Help pages and Policies to make sure you comply.
In particular, when accessing or using our Services, please ensure that:
- You are familiar with and acknowledge reading our Privacy Notice where we have compiled all essential information about our handling of your personal data and your corresponding rights.
- You are familiar with and agree to comply with Tise’s policies, which provide the rules for trading on Tise, including but not limited to our:
- You are familiar with and agree to the terms and conditions related to specific services offered on our sites. These will be presented to you at the time you enter into the service and/or be clearly available via the relevant Tise pages related to that service. These may include but are not limited to:
- Tise points
- Tise Paid Promotions
- Re-tise
Please refer to Clause 25 (Updates to these Terms) for information about changes to these Terms or our Policies and additional terms. You should regularly review the terms of any applicable Policies or services before using Tise.
3. What Tise is (and isn’t)
Tise is a marketplace where people can discover, list, buy and sell items. Services cannot be offered or exchanged on Tise. We are not involved in the actual transaction between the buyer and seller. The contract for the sale is directly between the buyer and the seller. Tise is not a party to that contract. Unless we say otherwise for a specific program, we do not have possession of anything listed or sold through Tise. Users are responsible for items, listings, pricing, taxes, and legal compliance. Buyers are responsible for deciding whether to buy and for paying the agreed price. See Clause 11 (Shipping and returns).
Users are responsible for their actions and should evaluate the credibility of other users before transacting. Tise does not inspect, warrant, or guarantee the quality, condition, legality, authenticity, or delivery of items listed on the Service, and does not transfer legal ownership of items. To the fullest extent permitted by law, all consequences of buying and/or selling through the Service are solely your responsibility.
4. Eligibility and accounts
You must be 18 or older to open an account or use Tise.
Keep your account details accurate and secure. Don’t share your login or transfer your account without our consent.
Personal accounts are for individuals, not for companies or organisations.
To activate your full account features and so you can post tises, Stripe is required to receive details to ensure compliance with applicable anti-money laundering or other laws.
5. Using Tise
Tise may not be used for any purpose that is illegal, beyond the scope of its intended use, or otherwise prohibited in these Terms. We have absolutely no tolerance for inauthentic, objectionable content and/ or abusive behaviour. When listing on Tise and using the Services, you must always comply with applicable law and our Policies, including ourProhibited and Restricted Items,Prohibited Practices,CounterfeitandIntellectual Property.
You must not:
- use the Services if you are not able to form legally binding contracts, are under the age of 18 or are suspended from using the Services;
- infringe any laws, third party rights or our Policies;
- list, sell or ship illegal, dangerous, infringing, counterfeit, or otherwise prohibited items;
- list any financial products or financial services (as those terms are defined in the Corporations Act 2001);
- post content or items in inappropriate categories or areas on our Services;
- fail to ship items you sell, fail to pay for items you buy, or abuse returns or buyer/seller protections;
- post harmful content (including content targeting or endangering children), hate or harassment, doxxing, spam, or explicit sexual content;
- manipulate feedback or reviews (including engaging in review swapping or operating multiple accounts) or post content that is defamatory or offensive;
- upload or distribute malware, phishing links, viruses or any other technologies that may harm the Services, Tise or the interests or property of Tise users;
- harvest or otherwise collect, publish, sell, or misuse information about users and/ or others’ personal data, including email addresses, without their consent or distribute or post spam, unsolicited or bulk electronic communications, chain letters or pyramid schemes;
- misuse Tise’s intellectual property or third party intellectual property (including photos, text, trademarks); or
- interfere with the operation or other users’ enjoyment of the Services.
We reserve the right to remove items and content which do not comply with these Terms, or any other Policies at our sole discretion. In addition, failure to abide by the Policies or these Terms may result in consequences as set out in Clause 19 (Breach).
6. Listing and buying
You must describe items honestly, provide accurate photos, set a clear price and state any return terms.
When listing on Tise, you must always comply with our Policies relating to listings, and you assume full responsibility for the content of the listing and the item offered. The following listing conditions apply:
- You are solely responsible for the accuracy, legality and content of your listing and item (including content produced with translation, image‑editing or AI tools) and you must follow all applicable Policies (including our Prohibited and Restricted Items Policy). Content that violates our Policies may be modified, not displayed, or deleted by us.
- Listing visibility, placement and time to appear in search/browse aren’t guaranteed. We may limit, hide or remove listings (including duplicates) to protect buyer experience.
- We may edit, supplement, restrict or remove listing content, meta‑tags or links, and revise product/catalog data to improve accuracy or enforce our Policies. We may also add platform content (for example, information about our programs or services) to your listing.
- Placement depends on buyer signals, item details, and seller performance. Paid upgrades/promotions may affect placement and may not be available everywhere. We may surface your listing on some of our other services.
- We may show optional listing recommendations based on aggregated performance data, and to power these features we may display your listings’ sales/performance history to other sellers.
- We may advertise and syndicate your listings across our services and with third parties (e.g., comparison sites and ad placements).
- Tools we offer (including AI) may be unavailable or inaccurate. You remain responsible for your listings.
- When listing an item on Tise, you understand that buyers are permitted to make bids of up to $300.
7. Fees
Joining Tise and selling items on Tise is generally free. However, there may be fees that apply to specific features, categories or services that you choose to use. If you choose to use any such features, categories or services, you have an opportunity to review and accept the fees that you will be charged in-product, prior to transacting. Such fees may also be set out in a separate fee schedule or Policy published on our website and app.
You agree that a service fee will be payable by you when you use the Services to buy an item (“Service Fee”). The Service Fee will be paid on the final item price agreed between you and the seller, excluding taxes or delivery/ shipping costs. Details of the Service Fee for buyers are set out in our Service Fee Policy.
You will be able to review the Service Fee payable prior to buying an item and the amount of the Service Fee paid will also be shown in your order confirmation message and email receipt.
Unless otherwise stated, all fees are quoted in Australian Dollars and inclusive of tax (e.g. consumption taxes including Goods and Services Tax (GST), Value Added Tax (VAT), Sales and Use Tax, etc. where applicable).
We may change our fees from time-to-time by updating the fees displayed on our website and app as well as any relevant fee schedules or Policies. New or changed fees apply prospectively to transactions or features started after the effective date. We will notify existing users of any material changes to our fees. No notice will be provided for any reduction in our fees.
Fee evasion is prohibited (for example, by asking a user to complete a transaction outside Tise). If we believe you attempted to circumvent fees, we may charge the applicable fees, limit or suspend your account, remove listings, and/or withhold payouts to cover amounts owed.
Sellers are responsible for determining, collecting, reporting, and remitting any taxes arising from their sales. Where required by law, Tise may calculate, collect, and/or remit taxes, and if we do, we will disclose this in the product or applicable Policy. Where permitted by law, we may recover from you any taxes, penalties or interest arising from your non‑compliance. Fees charged by Tise may themselves be subject to tax.
8. Buyer Protection
Purchases on Tise are covered by Buyer Protection. When you pay and complete your order on Tise, we help try to resolve problems, and where important conditions are met (including time frames), arrange a refund. Buyers and sellers acknowledge and agree that we may exercise our reasonable discretion, based on the information known to us at the time, to make a final decision on any buyer protection case. Full details of what is and is not covered by Buyer Protection and relevant conditions are set out in our Buyer Protection Policy.
9. Tise points
You automatically collect Tise points when you create a Tise account in Australia. Your Tise points are linked to your Tise account. Tise points can be redeemed as a discount on applicable delivery/shipping costs, service fees imposed by Tise, or in any other way specified pursuant to a special promotion that Tise may offer from time to time. Please refer to the Tise points Terms and Conditions.
10. Payments
Payment processing services for users on Tise are provided by Stripe. By using payments on Tise, you are either creating a Stripe Connected Account (“Stripe Account”), or are enrolling your existing Stripe Account with Tise’s Connected Platform Account. By doing so, you agree to the Stripe Connected Account Agreement, as modified by Stripe from time to time, which constitutes a direct legal agreement between you and Stripe. You are solely responsible for complying with the terms of the Stripe Connected Account Agreement. As a condition of Tise enabling payment processing through Stripe and your Stripe Account, you agree to provide accurate and complete information about you and (if applicable) your business, to keep it up to date, and you authorise Tise to share that information (and transaction data related to your use of the payment services) with Stripe, Stripe’s financial services providers or any payment method providers used by Stripe, so Stripe can enable Stripe Connect and provide its services, improve user experience, comply with law, and manage risk. You agree that you have obtained all necessary rights and consents under applicable law to disclose any required information to Tise and Stripe.
You authorise Tise and Stripe to obtain information about you (including from third parties that may include without limitation banks, credit and consumer reporting agencies, data brokers and service providers) as needed to verify identity, prevent fraud, verify the existence and location of your bank account, and comply with legal requirements (for example, “know your customer” checks). We may require additional information before enabling or continuing payouts, and we reserve the right to close, suspend, or limit your Tise account or rescind your access to any or all of our services in the event we are unable to obtain or verify any of this information. We are not responsible for any losses suffered by you as a result of incomplete or inaccurate information you provide.
Further, you grant Tise clear authorisation to perform specific actions on your behalf. Your authorisation to us , which is governed by the Stripe Connect Platform Agreement and your Stripe Connected Account Agreement, includes, but is not limited to, our ability to: create and connect your Stripe Account through Stripe’s API; access data in your Stripe Account through Tise’s Connected Platform Account; submit Stripe Account data, to Stripe;communicate with Stripe and manage issues and disputes (including chargebacks) related to your transactions; view and manage your transaction history, balances, and payout schedules; and update your account information and capabilities when required and upon your request. Tise will only engage in activity for your Stripe Account to the extent that Tise is doing so on your behalf, and in accordance with the authority granted in these Terms, including by incorporation Tise’s Privacy Notice. You are responsible for all activity performed in your Stripe Account. You understand that some third parties (such as banks, credit and debit card issuers, credit and debit card networks) may have, and in the case of Stripe does have, their own terms and conditions for the payment or settlement methods you choose to use in connection with payments, such as terms and conditions that relate to the settlement of funds, chargebacks, prohibited items, and overdrafts. Failure to abide by third-party terms and conditions may result in fees assessed to you, delays in your receipt of funds, or other actions taken by such third parties. You agree that we have no control over, or responsibility or liability for, such fees, delays, or actions.
Payout timing and availability depend on factors such as Stripe, verification status, risk controls, and your bank’s processes. We may request Stripe to place a hold, delay, or cancel a payout, or reverse a transaction if we reasonably believe it is necessary to comply with law, manage risk, or enforce our policies, including our Buyer Protection Policy (for example, in cases of suspected fraud, chargebacks, refunds, or disputes). You authorise Tise to request Stripe to recover any amounts you owe us (including fees, adjustments, or chargebacks), the amount of any refunds Tise has provided to buyers for any of your items that have not been delivered in circumstances where you have received the benefit of the proceeds relating to the transaction and/ or received the benefit of insurance provided by your shipping carrier, and amounts charged to Tise by shipping carriers for parcels you have under-declared (for example, by selecting the incorrect size or weight). In such instances, the recovery request could result in deducting those amounts from your Stripe Account balance, which can include deducting them from your current or future payouts through your Stripe Account or by charging your payment method Stripe has on file.
Buyers and sellers are responsible for resolving issues directly with each other unless a specific Tise Policy states otherwise. Tise is not a party to the contract between buyer and seller and does not guarantee refunds, returns, or exchanges. If a transaction is reversed by a payment provider or a buyer’s bank, you are responsible for the chargeback amount and any related fees.
Tise is not a bank, and we do not hold funds on deposit. Any funds are held, processed, and settled by Stripe or its financial institution partners. No interest is paid on balances.
We may update this Clause 10 (Payments) with notice. Continued use of payments on Tise after the effective date constitutes acceptance of the updated terms.
11. Shipping and returns
Sellers
Unless a particular Tise program says otherwise, shipping, delivery and returns are arranged between buyer and seller. Shipping and delivery services are supplied by shipping carriers. Shipping costs include GST. Generally, Tise collects GST as an agent of the shipping carrier. By using a shipping carrier, you acknowledge and agree to the shipping carrier’s terms and conditions and you accept responsibility for complying with those terms. If you offer returns, please set out the return window and who pays return shipping.
We may need to pass your information to the relevant carrier for the purpose of providing you with access to their shipping services and for related purposes. See our Privacy Notice for more information.
Buyers
If the buyer is requesting to return an item for "change of mind" (or "remorse") reasons, they are not entitled to a refund unless the seller agrees to this. Sellers may exercise their discretion to accept or deny a remorse return request, subject to applicable laws.
For items delivered by Sendle, signature on delivery is not available. Sendle will deliver items to you with an authority to leave. This means the item will be delivered to the delivery address even if the buyer is not there to receive it. The buyer must provide a delivery address that is safe to receive deliveries if Sendle is the selected shipping carrier.
12. Your content and our IP
You own the content you post. To operate, provide, improve and promote the Services, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free licence to use the content, including without limitation to host, store, reproduce, adapt (including to create derivative works), publish, publicly perform/display, distribute and otherwise use your content on and off the Services, including for marketing purposes, in any media known now or in the future. This licence includes the right to sublicense (through multiple tiers) to our users, affiliates, service providers and partners for these purposes.
We (and our licensors) own the Services, including the platform, software, brand, and all related content. We grant you a personal, limited, non‑exclusive, non‑transferable, revocable licence to use the Tise website, applications, and features in accordance with these Terms. You must not reverse engineer, decompile, disassemble, rent, lease, sell, sublicense or otherwise misuse our Services, content or code.
Our names, logos, designs and phrases used in connection with the Services are our trademarks, service marks or trade dress. You may not use them unless we expressly authorise you in writing.
13. Reporting, moderation, restrictions and appeals
We operate a reporting process for illegal content and IP complaints. Rights owners and users can report suspected infringements or illegal content using our in‑product reporting tool. We may remove or block content, restrict accounts and share necessary information with competent authorities and rights owners as permitted by law.

To protect our community and comply with law, we can remove content, lower its visibility, limit features, suspend or terminate accounts, and hold or delay listings or transactions.
When we take action, we may provide an explanation and outline any available review options, where required.
14. How recommendations work
Default recommendations consider factors such as query relevance, item quality and price, seller performance, buyer engagement and market signals. You can adjust results using filters and sort orders.
Sponsored or paid placements will be clearly labelled.
15. Service changes and availability
We work hard to keep Tise available and improving, but we cannot guarantee continuous or error‑free service. We may change, pause or discontinue features or the Services. We will try to give notice where practical.
16. Liability
To the maximum extent permitted by law we are not liable to you in contract, tort (including negligence) or otherwise for any business losses, such as loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption or for any losses arising, directly or indirectly from:
- your use of or your inability to use our Services;
- pricing, postage or other guidance provided by us;
- delays or disruptions in our Services;
- viruses or other malicious software obtained by accessing, or linking to, our Services;
- glitches, bugs, errors, or inaccuracies of any kind in our Services;
- damage to your hardware device from the use of any Services;
- the content, actions, or inactions of third parties, including items listed using our Services or the destruction of allegedly fake items;
- a suspension or other action taken with respect to your account;
- the duration or manner in which your listings appear in search results; or
- your need to modify practices, content, or behaviour or your loss of or inability to do business, as a result of changes to this User Agreement or our policies.
Regardless of the above, and to the extent permitted by law if we are found to be liable, our liability to you or to any third party is limited to the greater of (a) the amount of fees in dispute not to exceed the total fees which you paid to us in the 12 months prior to the action giving rise to the liability, or (b) $250. Nothing in this clause is, or is intended to limit or restrict any rights which you may have under the Australian Consumer Law.
17. Your responsibility
You are responsible for your use of Tise and your compliance with law. If you breach these Terms or infringe third‑party rights and that causes us loss, you agree to compensate us for reasonable losses, costs and expenses we incur as a result.
18. Release
If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint venturers and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. Subject to other terms in this agreement, this release does not apply where Tise’s acts or omissions were a direct cause of the matters giving rise to the dispute.
19. Breach
Without limiting other remedies available to Tise at law, in equity or under these Terms, to protect our legitimate business interests we may, without notice to you and in our sole discretion (which shall be exercised reasonably, having regard to and being commensurate with the nature of the circumstances), delay listing your item, delete your listing, request additional information or documentation from you, issue you a warning, restrict your activities through our site (including but not limited to buying, selling and posting activities), temporarily suspend, indefinitely suspend or terminate your membership and refuse to provide our services to you, reduce your Tise points balance to zero, or require you to pay additional fees if any of the following circumstances arise (each of which will or may cause harm to our business and/or the rights and obligations of other users):
- you have, or we reasonably believe that you have, breached these Terms, which includes any of our Policies in any way;
- you have, or we reasonably believe that you have, breached the conditions of the Payments Terms of Use;
- we, or your payment processor Stripe, are unable to verify or authenticate any information you provide to us;
- we reasonably believe that your actions may cause loss or damage to or otherwise unlawfully harm you, our users, third parties or us, our related bodies corporate or affiliates, our directors, employees or agents;
- we reasonably believe we need to do so to address or prevent fraud and abuse or for safety or security reasons;
- a regulator has raised concerns about your listings or certain types of listings, and/or we reasonably believe that we need to do so in order to comply with a regulatory obligation or request;
- we reasonably believe that any of your information (which includes an item listed on the site) is inappropriate or of an offensive nature; or
- we reasonably believe that your use of the Services is detrimental to other members and/ or Tise’s legitimate business interests.
If the nature of the action requires it, we will notify you of such action. In circumstances where we reasonably believe there are legitimate business reasons for withholding details of any investigation we conduct or any action we take in relation to your membership or your account (including but not limited to security, confidentiality and privacy reasons), we may be unable to provide you with notice of such action or provide you or other members with such details other than those that are already provided to you by us.
20. Term, suspension and termination
These Terms apply until your account is closed. You can close your account at any time (subject to any ongoing transactions). We can suspend or end your access for the reasons described in Clause 19 (Breach).
We will provide a statement of reasons and an appeal path where required.
21. Disputes
These Terms are governed by the laws of New South Wales. In the case of disputes, you and Tise will submit to the non‑exclusive jurisdiction of the courts of New South Wales, Australia.
22. Privacy
We use your personal data only as set out in our Privacy Notice. We view protection of users' privacy as a very important community principle. We use third parties to verify and certify our privacy principles.
23. Privacy of others; marketing
If we provide you with information about another user you agree you will use the information only for the purposes it is provided to you. You may not disclose, sell, rent or distribute a user's information to a third party for purposes unrelated to our Services. Additionally, you may not use information for marketing purposes, via electronic or other means, unless you obtain the consent of the specific user to do so.

25. Updates to these Terms
We may amend these Terms at any time by posting the amended terms on our website or app. We will notify you of any material amendments directly to the email address linked to your account, and/ or via website or in-app notifications. Except as stated elsewhere, all amended terms will automatically be effective 30 days after they are initially posted. If you keep using the Services after the effective date, you are accepting the changes.
Tise Policies and any additional terms for certain of its Services that form part of these Terms (as described in Clause 2 above) may also be changed from time to time by posting the amended terms on our website or app. The timeframe for amended Policy terms to come into effect and the way in which we notify you of material amendments will depend on the nature of the change and the circumstances giving rise to the need to change the Policy. For example, Policies may come into immediate effect as a result of urgent public health or safety requirements, or when the Policy has been updated for clarity but without changing our guidelines. We will notify users who are materially affected by the changes directly to the email address linked to their account, and/or via website or in-app notifications.
If you do not accept the changes, you should take steps to adjust your activity (such as ending listings affected by a Policy amendment), or close your account in accordance with Clause 19 (Breach). Where you have outstanding listings at the time of the amendment taking effect and prior to closure of your account taking effect, you agree that the amendments will apply to such listings unless and until you remove those listings or your account is closed, whichever occurs first.
26. Miscellaneous
If a clause is invalid, the rest stay in effect. We may assign our rights and obligations under these Terms as part of a reorganisation or group changeover. Headings are for convenience only.
